III. YOUR RIGHTS IN REAL ESTATE AGENCY SERVICES

Before hiring and while the service is provided, as a consumer you have, among others, the following rights:

  • Clear and understandable prior information (articles 20 and 60 TRLGDCU) about the features of the service, the total price including taxes, the duration, any exclusivity and the conditions for terminating the agreement.
  • Written agreement: the sale or letting mandate is documented in a signed listing agreement, of which you will receive a copy, detailing the services, fees, when they become payable and the duration.
  • Information about the property (Royal Decree 515/1989): if you buy or rent a home we offer, you can find out the identity of the owner, the description and floor area of the property, its land registry status and encumbrances, the total price and payment terms, the applicable costs and taxes and, where applicable, the energy performance certificate (Royal Decree 390/2021 of 1 June).
  • Binding advertising: the content of offers, promotions and advertising is enforceable even if it is not expressly included in the contract (article 61 TRLGDCU).
  • Protection against unfair terms: terms that have not been individually negotiated and that cause a significant imbalance to your detriment are not valid (articles 82 to 91 TRLGDCU).
  • Right of withdrawal: if the agreement is signed at a distance or off our premises, you may withdraw within fourteen (14) calendar days, without giving reasons and without penalty (articles 102 to 108 TRLGDCU). If you expressly ask for the service to start during that period, you will only pay the part proportional to what has already been provided and, if the service is completed within that period, you will lose the right of withdrawal, of which you will be informed beforehand.
  • Customer service and complaints: to submit complaints and claims and to receive a written reply, as explained in section V.

IV. PRICES, FEES AND COSTS

ACG Inmobiliaria is transparent about prices and fees. Before you make any commitment, we will inform you in writing of:

  • Agency fees: their amount or percentage of the price, always including VAT, when they become payable and who must pay them, as set out in the listing agreement. No amount not agreed in writing will be charged.
  • Additional services (such as home staging or photo shoots): they are only provided and invoiced with a prior quote accepted by you. The valuation requested through the Website is free and without obligation.
  • Property prices: in listings and communications we will state the total price and the taxes that apply to the transaction (VAT or Transfer Tax and Stamp Duty), as well as notary, land registry and agency costs, and how they are shared between the parties under the law and their agreement.
  • Residential leases: under article 20.1 of the Urban Leases Law, as amended by Law 12/2023, the real estate management and contract formalisation costs are borne by the landlord. They will not be charged to the tenant.
  • Municipal capital gains tax (plusvalía municipal): in sales, the Tax on the Increase in Value of Urban Land is legally payable by the seller, as the transferor taxpayer (article 106 of the consolidated text of the Local Finance Law).

V. CUSTOMER SERVICE, COMPLAINTS AND DISPUTE RESOLUTION

You can submit enquiries, complaints and claims free of charge through any of the following channels. We will give you proof of submission and reply in writing as soon as possible and, in any case, within a maximum of fifteen (15) working days:

  • Direct contact: by email ([email protected]), by phone (+34 604 92 21 34) or by post to Pl. de España, Casco Antiguo, 50002 Zaragoza, Spain.
  • Official complaint forms (hojas de reclamaciones): available on request at our office at Pl. de España, Casco Antiguo, 50002 Zaragoza, in accordance with Aragon Government Decree 150/2016. Once completed, you keep your copy and, if you are not satisfied with our reply, you can submit it to the Municipal Consumer Information Office (OMIC) of Zaragoza City Council or to the Directorate-General responsible for consumer affairs of the Government of Aragon.
  • Consumer arbitration: ACG Inmobiliaria has not joined the Consumer Arbitration System. You can still submit an arbitration request to the Aragon Consumer Arbitration Board (Junta Arbitral de Consumo de Aragón), which will forward it to us; if we expressly accept arbitration for your case, it will be handled voluntarily and free of charge and will end with a binding and enforceable award. If we do not accept it, all other complaint channels remain fully available to you.
  • Alternative dispute resolution entities accredited under Law 7/2017. The European online dispute resolution (ODR) platform ceased to operate on 20 July 2025; for cross-border disputes within the European Union you can contact the European Consumer Centre in Spain.
  • Court proceedings: you can bring actions before the courts of your place of residence, after first attempting, where legally required, an appropriate dispute resolution method (Organic Law 1/2025 of 2 January).
