I. GENERAL INFORMATION

In compliance with the information duty laid down in article 10 of Spanish Law 34/2002 of 11 July on information society services and electronic commerce (LSSI-CE), you are informed that the owner of this website, https://www.acginmobiliaria.com (the Website), is Andrés Cambon Gómez, a sole trader operating under the trade name ACG Inmobiliaria, tax ID (NIF) 73429392Y (ACG Inmobiliaria), whose activity is real estate agency in sales and lettings, property valuation and home staging. This English version is provided for information purposes only. In the event of any discrepancy, the Spanish version shall prevail.

Registration and professional details: the owner carries out the activity as a self-employed individual and is not registered with the Commercial Registry, registration being optional for sole traders (article 19 of the Spanish Commercial Code). Real estate agency is not subject to prior administrative authorisation or mandatory membership of a professional association, and at the date of this review there is no mandatory regional register of real estate agents in Aragon. II. GENERAL TERMS OF USE

Purpose and acceptance

These General Terms of Use (the Terms) govern access to and use of the Website, understood as the set of pages, texts, images, designs, tools, forms and other elements (the Contents), as well as the online services it offers (the Services), such as requesting a property valuation.

ACG Inmobiliaria may change the presentation, configuration and Contents of the Website, as well as these Terms, at any time. Changes take effect from their publication and do not affect requests already sent or contracts already concluded, which are governed by the terms in force when they were formalised.

Access to the Website is free of charge, except for the cost of the User's internet connection. Requesting a valuation is free and does not oblige you to hire anything. Real estate agency services are not contracted through the Website but by signing the corresponding listing agreement, which will set out in writing its terms, price and duration.

The User

Anyone who accesses and uses the Website is a User. Access implies knowledge and acceptance of these Terms; if you do not agree with them, you must refrain from using the Website. Using the forms also requires reading the Privacy Policy and, where applicable, giving the corresponding consent.

The User undertakes to use the Website diligently, lawfully and in good faith, and in particular to:

Provide truthful, accurate and up-to-date information in the forms and report any changes, being liable for any damage caused by false or inaccurate information.
Not enter third parties' data without their authorisation or impersonate another person.
Not use the Website for unlawful or fraudulent purposes or in breach of third-party rights, nor to send unsolicited commercial communications.
Not introduce viruses or malicious code, nor carry out actions that may damage, overload or prevent the normal operation of the Website, such as automated mass form submissions.
Not access or attempt to access restricted areas of the Website, such as the management panel reserved for authorised staff.
Not systematically extract, reuse or exploit the Contents using robots, scraping or similar techniques.

ACG Inmobiliaria may temporarily restrict use of the forms or deny access to anyone who breaches these Terms, without prior notice and without prejudice to any legal action that may be appropriate.

The User is solely responsible for the opinions and content they publish on third-party spaces linked from the Website, such as social networks.

Merely accessing the Website or sending a valuation request does not create any contractual relationship between the User and ACG Inmobiliaria.

The Services are intended for adults with legal capacity to enter into contracts. Children under fourteen (14) may not provide us with their data without the consent of their parents or guardians.

III. ACCESS, AVAILABILITY, CONTENTS AND LIABILITY

ACG Inmobiliaria endeavours to keep the Website continuously available and working properly, but does not guarantee that it will be free from interruptions or errors due to technical reasons, maintenance or causes beyond its control. To the extent permitted by law, it is not liable for damage arising from such interruptions, from viruses or elements introduced by third parties despite the security measures adopted, or from misuse of the Website by the User.

Information about properties, prices and the market published on the Website is for information and guidance only, is not a binding offer and may change without notice. Valuations provided through the Website are commercial estimates and are not equivalent to an official appraisal carried out by an approved appraisal company. Blog articles are informative and do not replace professional legal or tax advice. All of the above is without prejudice to the binding nature of offers, promotions and advertising under article 61 of the consolidated text of the Spanish General Law for the Protection of Consumers and Users.

As an information society service provider, ACG Inmobiliaria is liable in accordance with articles 13 to 17 LSSI-CE. Nothing in these Terms limits any liability that cannot be excluded by law or the rights that consumer protection law grants to the User.

IV. LINKS

The Website includes links to third-party sites and services (for example, Google Maps, WhatsApp, Instagram, TikTok or Facebook) solely to make it easier for the User to access information or contact channels.

ACG Inmobiliaria does not control those sites, does not approve or endorse their contents and services, and is not responsible for their availability, accuracy or lawfulness, nor for the processing of data carried out by their owners under their own policies.

Under article 17 LSSI-CE, ACG Inmobiliaria will only be liable for linked content if it has actual knowledge that it is unlawful and does not act diligently to remove or disable the link.

Links to the Website from third-party pages must comply with the following conditions:

Links from pages whose content is unlawful, discriminatory, contrary to morality or public order, or harmful to the rights of third parties are prohibited.

Creating a link does not authorise the use of the trademarks, trade name or other distinctive signs of ACG Inmobiliaria.

The link must point to the home page or to specific pages of the Website, without reproducing or framing its Contents.
No false, inaccurate or incorrect statements may be made about ACG Inmobiliaria, its services or its Contents.
It must not be implied that ACG Inmobiliaria has authorised the link, endorses or collaborates with the linking site, unless expressly agreed.

ACG Inmobiliaria may at any time request the removal of a link to the Website that does not comply with these conditions.

V. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Contents of the Website, including texts, photographs, images, logos, the trade name ACG Inmobiliaria, graphic designs, source code and the selection and arrangement of the elements, belong to ACG Inmobiliaria or to third parties who have authorised their use, and are protected by Spanish Royal Legislative Decree 1/1996 of 12 April approving the consolidated text of the Intellectual Property Law, by Law 17/2001 of 7 December on Trademarks and by the applicable international treaties.

All rights reserved. The reproduction, distribution, public communication, making available and transformation, in whole or in part, of the Contents without the prior written authorisation of ACG Inmobiliaria is prohibited, except where permitted by law. Photographs and descriptions of properties are published with the authorisation of their owners and may not be reused on other portals or listings.

You may view the Contents and download or print them for strictly personal and private use, provided that they are not altered and their source is kept. In accordance with article 67.3 of the consolidated text of the Spanish Intellectual Property Law and article 4 of Directive (EU) 2019/790, ACG Inmobiliaria expressly reserves the use of the Contents for text and data mining, including the training of artificial intelligence systems.

VI. GOVERNING LAW AND JURISDICTION

These Terms are governed by Spanish law. If any clause is declared void, the remaining clauses will remain valid.

Where the User is a consumer, disputes will be submitted to the courts of their place of residence, in accordance with article 90.2 of the consolidated text of the Spanish General Law for the Protection of Consumers and Users and article 52.1.14 of the Spanish Civil Procedure Act. In all other cases, the parties submit to the courts of Zaragoza.

Before going to court, the User may use the complaint channels and out-of-court dispute resolution systems described on the Consumer information page, and must use an appropriate dispute resolution method where required by Spanish Organic Law 1/2025 of 2 January.
